Medical negligence refers to the negligence or an act of recklessness by a healthcare professional that can result in foreseeable damage to the patient. 

Medical negligence also includes any act of misconduct by a doctor or medical practitioner by not providing adequate care resulting in the breach of his duties and causing harm to the patients, who are considered his consumers. 

A medical professional is deemed to possess the knowledge and expertise in the field of medicine to help a patient get healed. The patients expect the physician to be careful and diligent while performing these duties. Medical negligence involves improper, negligent, or unskilled treatment even by dentists, nurses, pharmacists, and other healthcare professionals.

Medical negligence may cause serious harm to the patient’s health and even result in his death. The liability in such cases lies with the physician as well as the hospital, pharmacists, nurses, laboratory technicians, and other healthcare professionals who were involved in the management of the patient’s condition. 

Hence, doctors must be aware of medical negligence in terms of various laws. 

Medical malpractice may occur when the healthcare provider strays from the permissible or approved “standard of care” in the management of the patient's illness or fails to identify any obvious signs or future treatment options resulting in a delay in providing timely treatment to the patient.

The “standards of care” in this case can be defined as what could be considered reasonably prudent for a medical provider to do under similar or the same circumstances.

This is what makes the laws related to medical negligence somewhat ambiguous. It is very difficult to determine the exact right treatment the patient should have been given because the symptoms, the results of tests, the stage of diseases, and other factors differ among different patients. 

Yet, it becomes the duty or responsibility of the doctor to ensure the patient is provided the best treatment depending on his individual case.
